Terms & Conditions

These Terms & Conditions govern all quotations, bookings, services and works undertaken by Legacy Outdoor Living Ltd ("the Company", "we", "our", "us"). By accepting a quotation, paying a deposit, instructing Legacy Outdoor Living Ltd to commence work, or otherwise engaging our services, the customer agrees to these Terms & Conditions.
1. Quotations
All quotations are valid for 30 days unless otherwise stated. Quotations are based upon information available at the time of survey and site inspection. Quotations may be amended where unforeseen conditions or circumstances arise. Quotations may be withdrawn or revised prior to acceptance.
2. Material Price Fluctuations
Quotations are based upon material, supplier and labour costs applicable at the time the quotation is prepared. Where a quotation has not been accepted within 14 days, Legacy Outdoor Living Ltd reserves the right to revise pricing to reflect any increases in material, supplier, labour, fuel, disposal or transportation costs. In the event of significant cost increases occurring after a quotation has been accepted but before materials have been purchased, Legacy Outdoor Living Ltd reserves the right to discuss and agree reasonable adjustments to the contract price with the customer before proceeding. Should the customer choose not to proceed following such adjustment, either party may cancel the contract without further liability, save for any costs already incurred by Legacy Outdoor Living Ltd.
3. Acceptance of Quotation
Acceptance of a quotation, whether verbally, electronically or in writing, shall constitute acceptance of these Terms & Conditions and form a binding agreement between the customer and Legacy Outdoor Living Ltd.
4. Deposits
The Company reserves the right to request a deposit before works commence. Deposits are used to secure booking dates, labour, materials and project planning. Deposits are non-refundable once materials have been ordered, labour has been allocated, plant hire has been arranged or project preparation has commenced.
5. Payment Terms
Unless otherwise agreed in writing: Deposits must be paid before works commence. Interim payments may be required for larger projects. Final payment is due immediately upon completion of works. Ownership of all materials remains with Legacy Outdoor Living Ltd until payment has been received in full. Failure to make payment may result in suspension of works. The Company reserves the right to charge interest on overdue invoices at the statutory rate permitted under applicable legislation. The customer shall be responsible for all reasonable costs incurred in recovering outstanding payments.
6. Additional Works & Variations
Any work requested by the customer outside the agreed quotation will be charged separately. Where reasonably practicable, additional costs will be discussed before work is undertaken. Verbal instructions from the customer authorising additional work shall constitute acceptance of additional charges.
7. Hidden Ground Conditions
Quotations are based on visible site conditions only. Legacy Outdoor Living Ltd reserves the right to charge additional costs where unforeseen conditions are encountered including but not limited to: Buried concrete, existing foundations, underground services, tree roots, drainage issues, contaminated ground, excessive waste, unstable ground conditions, unknown utility services, asbestos or hazardous materials.
8. Waste & Disposal
Unless specifically stated within the quotation, waste removal and disposal are not included. Where waste removal is included, quotations are based upon the volume of waste reasonably anticipated during survey. Additional charges may apply where excessive waste, hidden materials, contaminated waste or unforeseen disposal requirements are encountered.
9. Access to Site
The customer shall provide safe and reasonable access to the site and work areas. Any delays caused by restricted access, neighbouring properties, third parties, unavailable utilities or customer actions may result in additional charges.
10. Delayed Customer Decisions
Where works are delayed due to the customer's failure to provide instructions, approvals, selections, access or decisions necessary to progress the project, Legacy Outdoor Living Ltd reserves the right to reschedule works and recover any reasonable costs incurred as a result of such delay.
11. Weather Delays
Outdoor landscaping and construction works are weather dependent. Legacy Outdoor Living Ltd reserves the right to postpone, suspend or reschedule works due to adverse weather conditions without liability for delays or associated losses.
12. Living Materials
Plants, turf, trees, shrubs and other living materials are affected by weather, soil conditions, pests, disease, maintenance and factors outside the Company's control. Unless expressly agreed in writing, no warranty or guarantee is provided on living materials following installation.
13. Customer Responsibilities
The customer is responsible for: Obtaining any permissions required from landlords, management companies or third parties; Identifying any known underground services; Providing suitable access; Ensuring pets and children are kept away from active work areas; Maintaining installed features, planting and landscaping following completion.
14. Completion of Works
Works shall be deemed complete when the agreed scope of works has been substantially completed. Minor snagging items shall not constitute grounds for withholding payment.
15. Complaints
Any concerns regarding completed works must be reported within 7 days of completion. Legacy Outdoor Living Ltd shall be given a reasonable opportunity to inspect and rectify any genuine defects before third parties are instructed. The Company shall not be responsible for the cost of remedial works undertaken by third parties without prior written agreement.
16. Photography
Legacy Outdoor Living Ltd reserves the right to photograph completed works for quality control, marketing, portfolio and social media purposes unless otherwise agreed in writing. No personal information or identifying details will be disclosed without consent.
17. Limitation of Liability
Nothing within these Terms & Conditions excludes liability where exclusion is prohibited by law. Subject to this, Legacy Outdoor Living Ltd's total liability arising from any contract shall be limited to the total value of the works carried out under that contract. Legacy Outdoor Living Ltd shall not be liable for: Indirect losses, consequential losses, loss of profits, loss of business opportunity, loss of enjoyment, or delays caused by circumstances beyond our reasonable control.
18. Force Majeure
Legacy Outdoor Living Ltd shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to severe weather, supplier delays, labour shortages, utility failures, strikes, government restrictions, accidents, emergencies, natural disasters or other unforeseen events.
19. Governing Law
These Terms & Conditions and any contract entered into between the customer and Legacy Outdoor Living Ltd shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute, claim or matter arising out of or in connection with the services provided by Legacy Outdoor Living Ltd shall be subject to the exclusive jurisdiction of the courts of England and Wales.
